Battle of Standing Rock - TERMS AND CONDITIONS To enter, simply read
these conditions, then complete and submit the on line
registration. The deadline is the Saturday of the week before the
starting date of the preliminary (Feb 26th, 2007). (Please note:
enter as soon as you can, the Promoter cannot guarantee placement of
later entries).
Only one entry per
band/group. A band/group must have two or more
members - no solo acts will be allowed. The promoter reserves the right
to accept or reject entries at their absolute discretion. All decisions
of promoters, staff, and/or judges are final and without appeal.
All band members must be
18 years or over, or 14 years or older with
explicit written permission from parent/ legal guardian being provided
to the group’s “Responsible Adult Party”
All
preliminaries will be held on weeknights. If there are any
participating bands with members under 18, hours of competition will
reflect local/state laws with regard to curfews and other applicable
juvenile laws. Please be aware that venues will require photo ID due to
their licensing obligations. No recourse will be given should the band
member's age not fit the criteria/obligations of the venue due to lack
of disclosure by the band or its members. Any band with participants
under the age of 18 must have an identified “Responsible
Adult
Party” 21 years of age or older. There are no exceptions to
this
requirement.
Bands must not be
currently signed to a record company, or have
released more than five albums themselves. “EP's”
and
singles do not count as released albums.
Each band must perform a
minimum of two musical works written and
controlled by the Band ('the Original Works') in their set. (Therefore
cover songs are permitted but you must have a minimum of 2 original
songs). Band member / line-up changes are permitted, but no more than 2
members during the event duration. Adding additional band members is
not allowed without the prior approval of the Promoter.
Basic PA system,
microphones and sound engineer are provided at most
venues. Bands are required to provide all their own instruments / back
line equipment ( i.e., drums, amps, keyboards, guitars, etc.). You may
bring your own sound engineer to assist with prior approval of the
Promoters. Contact details must be provided at least 72 hours in
advance of your scheduled appearance.
Bands must be available
to play at designated dates at the assigned
venue for their participation bracket anytime between the start dates
and final dates of the contest. The band must also be available to
perform at the finals on May 26th at the finals venue.
Bands are to be available
for promotional commitments if required.
The Promoter accepts no
responsibility for incomplete entries, or those
lost or delayed for any technical or other reason. Bands will be
informed by the Promoter 5 – 10 business days after entering
of
the acceptance or ineligibility of their performance, including
performance date, venue and further details.
The band agrees to allow
the promoter to record, film and/or photograph
the performance(s) of the band. The promoter owns the copyright in
these recordings / images.
The Band and all members
it comprises, hereby warrants that they are
either the owners or controllers of the copyright of the Original Works
and are free to enter into this agreement and by doing so grant to the
Promoter a non-exclusive license allowing the work to be reproduced in
all media for promotion or any other use without recourse to any
payment or fee. If any material is used for broadcast or other such
use, only the Original Works will be used (No cover versions).
At all times during the
competition and/or subsequent promotion of the
competition, the band agrees to act in a professional manner that
supports and reaffirms the reputation of the Promoter and sponsoring
companies, organizations, and venues. To this end the Promoter reserve
the right to cancel any band where this reputation is under threat by
actions from any band member or associate.
Bands are responsible for
all travel related expenses that they might
incur as a result of participation in this event. The Promoter in no
way assumes any responsibility for the safe travel or transportation of
band members and/or their equipment. The Promoter also is absolved of
any responsibility for the safety, well being, or any resulting
consequence of acting in an unacceptable or criminal manner of the
participants, their minions, fans, other attendees or accompanying
adults in the case of minor participants.
Prizes are
non-transferable and there is no cash alternative for any
goods offered. In the event that, having been notified of a placement
in a semi final, or final, the band is unable to confirm their
attendance by the date required by the Promoter, they are therefore
deemed to have forfeited, and the Promoter will subsequently nominate
another band.
The winning band(s) will
be announced on the night of each show and
Judge's decisions are final and wholly without appeal. The winning
band(s) will receive further details following their win, regarding
placement in any semi final or final as well as any prize details if
relevant. There will also be Wild Card winners determined by the judges
after the end of the preliminary rounds that will be invited, solely at
their discretion, to the semi-final round of competition.
The Promoter reserves the
right to terminate or temporarily suspend
this competition in the event of technical or other difficulties that
might compromise its integrity.
The terms and conditions
are governed by United States, State of Ohio
and local laws (as applicable) and are subject to the exclusive
jurisdiction of the Ohio courts.
By submitting an
application to participate in this event, all
participants are deemed to have accepted these terms and conditions.
